CallnRoam® Consumer Disclaimer

All Services for CallnRoam are provided by BRIDGEVOICE, INC.  (hereinafter, referred to as BVI). BVI is a licensed and certified telecommunications provider. "CallnRoam" is a call forwarding service intended to redirect domestic and international calls to a United States telephone number for business and personal use."

As a subscriber, CallnRoam customers can make and receive calls from a CallnRoam Local Phone Number in the visiting country, be it the United States of America, or any other country that CallnRoam offers its services - such as India. The service is offered in three (3) different packages from which the customer may choose individually OR as a complete bundled package solution.In case of bundled plans, there would be separate bills for each individual plan within the bundle. Billing would follow the activation/use of the individual plans.

  • Each individual customer shall be provided with a User ID & a password.
  • All plans/services shall be offered on a prepaid basis only.
  • The plans/services shall be activated upon 1st use.
  • The rates applicable shall correspond to those prevailing at the time of activation by the customer and shall be deducted from the customer’s prepaid balance.
  • Rates and promotional offers are subject to change without prior notification.

Pay As You Go Plan

Rates shall apply based on the rate plan selected. Rates, fees and promotions are subject to change at any time without prior notification. Customer balance shall be redeemed based on the per-minute charge for the called destination. Rates are based on the use of Local Access Numbers. Use of Toll-Free numbers to avail the service shall incur an additional $0.02/min. $0.99 applies to every call made from a payphone. All calls shall be billed in 1-minute increments. The Validity of the Pay As You Go plans is 1 year from the date of 1st use. For the India @ 1c plan, there shall be a $0.99 Service Charge on the $10 plan and $1.99 on the $25 plan.


Unlimited Plan- Fair Usage Policy :

Unlimited Plan is intended for Normal Residential use only and is subject to Fair Usage Policy of 1,800 minutes per month. For your convenience, Auto-recharge shall be selected by default however, it is not mandatory for this plan. Customer may choose to opt-out of the feature at any point of time.

Unlimited calling plan valid to use with a single registered phone number

Fraudulent/Suspicious Usage: BridgeVoice, Inc. reserves the right to block, prevent or refuse the use of its service if a fraudulent use is suspected.The service shall remain unusable till the extent that BridgeVoice, Inc. determines otherwise, beyond any admissible reason of doubt.


International Roaming

Rates based on usage of call-back facility only. Rates are subject to change without prior notification. Customer shall be responsible for any charges incurred due to direct calling without the use of our call-back facility. BRIDGEVOICE, or any of its affiliates, shall in no way be responsible for these charges. Customer is responsible for any incoming call charges within the country of travel, where incoming calls are chargeable. All calls coming on customer’s U.S. Number shall be forwarded to the Local (phone) number of the customer. Applicable rates for Voice and Text are found on our website and are valid for the duration indicated or as per the Service Provider. Please check with your service provider for charges for call forwarding. These are not included in the plan.

Upon Activation the service is operational for Thirty (30) calendar days and is available for use on 24/7 basis. Calls to your CallnRoam number can be made at anytime or any day of the week.  The call forwarding service of CallnRoam may only be forwarded to a registered phone number, either a landline or cellular. When registering for CallnRoam please indicate the exact telephone number that you wish the service to forward your calls and ensure that the number is correct and active.  The service is may not be used use with Public Payphones or computer based IP Phones.  The Service is not intended for use by Internet Cafes, Call Shops, or for any other type of commercial resale.  BRIDGEVOICE is not responsible for calls registered to a telephone number by the consumer that are prohibited or in error.


Telebabad Kabayan 30-day Plan

Telebabad Kabayan plan is intended for home &/or personal use only and is not meant for business users. In order to avoid abuse of the service, subscribers to the Philippines Globe Unlimited Calling plan “Telebabad Kabayan” are subject to fair usage policy of 2000 minutes per month. Subscribers shall further be allowed to use the service from 1 phone number only, whether landline or cell phone. This phone number cannot be changed at any point of time during the validity of the plan. In case the subscriber wishes to use another number, they will need to purchase a separate plan subscription. Calls are allowed to only 5 numbers in the Philippines. Further, these numbers should belong to Globe Group Network, including Globe Mobile (Prepaid & Postpaid), Touch Mobile (TM), bayanPhone and Globe Lines numbers, except numbers starting with 817, 937 and 996. These 5 numbers cannot be substituted during the validity of the plan. In case a subscriber wishes to call more numbers, they would need to purchase another subscription. Month is considered as equivalent to 30 Calendar days from the day of 1st use, including the 1st use day/date itself.


Telebabad Kabayan 7-day Plan

Philippines Globe 7-day plan is intended for home &/or personal use only and is not meant for business users. In order to avoid abuse of the service, subscribers to the Philippines Globe Unlimited Calling plan “Telebabad Kabayan” are subject to fair usage policy of 500 minutes per week. Subscribers shall further be allowed to use the service from 1 phone number only, whether landline or cell phone. This phone number cannot be changed at any point of time during the validity of the plan. In case the subscriber wishes to use another number, they will need to purchase a separate plan subscription. Calls are allowed to only 5 numbers in the Philippines. Further, these numbers should belong to Globe Group Network, including Globe Mobile (Prepaid & Postpaid), Touch Mobile (TM), bayanPhone and Globe Lines numbers, except numbers starting with 817, 937 and 996. These 5 numbers cannot be substituted during the validity of the plan. In case a subscriber wishes to call more numbers, they would need to purchase another subscription. Week is considered as equivalent to 7 Calendar days from the day of 1st use, including the 1st use day/date itself.


Calling Card

Our CallnRoam Services can also be used as a Pre-paid Calling Card services. The CallnRoam Service is designed such that remaining balances, on return from travel, may be applied to a U.S. PIN less Calling Card. They can recharge anytime or add or subtract services easily by selecting the PIN less feature under MY ACCOUNT on our website. Rates are subject to change without prior notification. All calls are billed in 1-minute increments.

Regardless of the service plan, the CallnRoam subscriber may be issued a U.S. phone number that the United States or international callers may call. All calls made to this number shall be forwarded to a mobile or fixed line telephone number of the subscriber’s choice. Subscribers may elect to have international calls answered by an international call-back service billed to their account pursuant to their service agreement. The service is offered on a prepaid basis with all international charges for the calls forwarded being billed on a monthly basis. Charges for call forwarding are exclusive of any local phone charges that may apply with your local or business phone line or any applicable usage charges associated with a particular cellular phone or prepaid cellular phone used by the subscriber.


SmartCall Plans for India, Pakistan and Bangladesh

SmartCall Plans are country-specific plans. Calls are only allowed to the county for which the plan is purchased. To call any other country under the SmartCall Plan, the plan for that particular country shall have to be purchased, if available as such. Calls are only allowed from 1 phone number only, whether landline or cell phone. This phone number cannot be changed at any point of time during the validity of the plan. To use another number to make calls, a separate plan subscription shall have to be purchased. Rates shall apply based on the rate plan selected. Plans can only be purchased as a combination package of minutes and time duration. Rates, fees and promotions are subject to change at any time without prior notification. Customer balance shall be redeemed based on the per-minute charge for the called destination. Rates are based on the use of Local Access Numbers. Use of Toll-Free numbers to avail the service shall incur an additional $0.02/min. $0.99 applies to every call made from a payphone. All calls shall be billed in 1-minute increments. The Validity of the SmartCall plans are 30 days from the date of purchase (for India, Pakistan and Bangladesh plans). No Refunds are allowed on the SmartCall Plans.


SmartCall Philippines Plan

SmartCall Philippines Plan is a country and networks’ specific, prix-fixe plan. Calls are only allowed to Smart, Sun and PLDT numbers. Rates shall apply based on the rate plan selected. Rates, fees and promotions are subject to change at any time without prior notification. Plans can only be purchased as a combination package of minutes and time duration. Calls are only allowed from 1 phone number only, whether landline or cell phone. This phone number cannot be changed at any point of time during the validity of the plan. To use another number to make calls, a separate plan subscription shall have to be purchased. $0.99 applies to every call made from a payphone and will have an effect of decreasing the available number of minutes. All calls shall be billed in 1-minute increments. The Validity of the SmartCall Philippines plans is 30 days for the 2000 min. plan and 15 days for the 500 min. plan. Validity is calculated from the date of purchase and not from date of first use. All Sales for the SmartCall Philippines plans are final. There shall be absolutely No Refunds are allowed on the SmartCall Philippines Plans.

 


Top-up Services

International Mobile Top Up and US Wireless Recharge (collectively referred to as "Top-up Service") are services which allow U.S. consumers to recharge the airtime of a mobile phone of certain international and/or US Domestic third party operators. The Top-Up service is only provided to you by CallnRoam for the mobile phone operators available on the Website which are subject to change and availability. Further, the Top-up Service is merely a service that CallnRoam distributes and processes through its Website. Due to the mechanism of Top up transactions, WE CANNOT ACCEPT CANCELLATIONS, RETURNS, REFUNDS OR EXCHANGES once a transaction has been completed. Please exercise extra caution when entering the mobile number you wish to send Top up to. We will not be held liable for erroneous or mistaken entry of the mobile number. You acknowledge that you will lose the right to cancel or request a refund for the the Top-Up once the Top-Up has been completed. Occassionally, there may be a short delay before the relevant mobile operator applies the Top-Up to the mobile phone number.

 


 

 

BRIDGEVOICE does not warrant that the CallnRoam service is completely error or interruption free nor does BRIDGEVOICE warrant any particular call connection being successful.  BRIDGEVOICE is not responsible for calls dropped due to issues with user’s phone or by their phone service provider.  BRIDGEVOICE makes no representation or warranty express or implied including but not limited to any warranty of merchantability or fitness for a particular purpose or as to the quality of the call under CallnRoam. In no event will BRIDGEVOICE be liable for any indirect, special, incidental, or consequential losses or damages arising in any manner from the use of CallnRoam.  All sales are Final, Non-Refundable, Non-Transferable, and Non-Exchangable. CallnRoam has no cash value and may only be exchanged for replacement services, at the sole discretion of BRIDGEVOICE, and through its customer service line at 1-888-358-4002.


Electronic Contract/Website Terms and Conditions

Please read all BridgeVoice, Inc. Terms of Service carefully before accessing or using the Service. By accessing or using the Service, you agree to be bound by the terms and conditions set forth below. Any use of, purchase through, this website is expressly conditioned on your acceptance of all terms and conditions stated herein and any others that may be available on www.callnroam.com. DO NOT USE THIS WEBSITE OR PURCHASE THROUGH THIS WEBSITE if you do not accept all the terms and conditions stated on this website.WARNING: It is a Federal AND State Offense to purchase any product or service by fraudulent means. Any and all Products and Services purchased through this website shall not be used for any unlawful purpose.BY ACTIVATING OR USING THE CALLNROAM SERVICE, YOU REPRESENT THAT YOU ARE OF LEGAL AGE TO ENTER INTO THIS AGREEMENT AND THAT YOU HAVE READ AND UNDERSTAND FULLY THE TERMS AND CONDITIONS OF THIS AGREEMENT.These Terms of Service constitute an agreement ("Agreement") between BridgeVoice, Inc. The following Terms are applicable to all CallnRoam® Services:

Electronic Contract for Service. All CallnRoam services purchased on www.callnroam.com are done by electronic format contract with these terms and conditions. BridgeVoice shall make available your agreement in electronic format upon request. You may request access to these electronic records in either Adobe Acrobat (.Pdf format) or text formats. At all times, you retain the right to request and receive documents on paper upon request to BridgeVoice via e-mail or fax.

Governing Law, Jurisdiction & Venue. These Terms of Use shall be governed exclusively and construed in strict accordance with the laws of the State of New York. Customer, by virtue of purchase through this website, agrees to submit to exclusive jurisdiction and venue of the state and federal courts of Queens County, New York, and, expressly waive all defenses to jurisdiction without any consideration of conflict of law theories, case law or principles.

BridgeVoice is the Telecommunications and VoIP Provider of all services associated with CallnRoam and this website. BridgeVoice is the carrier providing all telecommunications and call-back services, either via prepaid or postpaid basis, in connection with the calling features of the CallnRoam service. BridegeVoice is certified as an Inter-exchange carrier in 26 states (see listing for all IXC CPNC certificates) and as a common carrier for federal regulatory purposes. Any and all services provided through this website are pursuant to New York and U.S. federal authorization and regulation of as an inter-exchange carrier. Any claim or complaint as to quality of service, service interruption or furnishing of services shall be directed to the attention of BridgeVoice for resolution, or alternatively, made with the corresponding State Public Utility Commission. BridgeVoice is intended for call forwarding and call back purposes only and not for outbound calling or E-911 support. This must be served by your subscribed mobile or landline carrier in accord with all applicable federal requirements of the Federal Communication Commission's E911 Order. BridgeVoice shall furnish Customer with a CallnRoam DID (Direct Inward Dialed) number for personal and business use by the Customer. This DID number must be associated with an existing telephone or mobile line to which the Customer subscribes. BridgeVoice bears no service responsibility in relation to air time availability, outages, or services related to the Customer's existing telephone or mobile line service or subscription and Customer agrees that such services are outside of the CallnRoam Service. BridgeVoice and CallnRoam may be used interchangeably in this Electronic Contract.

No Refunds on Prepaid Services Without Cause. BridgeVoice will not offer any refunds or reimbursements for the purchase price of the CallnRoam Service without cause. If customers experience problems with their CallnRoam Service they must first contact our customer service line at 1-888-358-4002 or e-mail support@callnroam.com to determine the nature of the problem or whether a refund is applicable. BridgeVoice exclusively reserves the right to determine whether a demand for refund is with or without cause. Any denial of a consumer refund by BridgeVoice may be referred to Customer's respective State Public Service or Utility Commission found above. BridgeVoice further reserves the right to terminate any dormant CallnRoam account that has not been used for a period of 365 days or longer. No refunds will be provided for any prepaid balance remaining on an account that is terminated as a result of being dormant.

Refund:You can only receive a refund/charge back if your CallnRoam plan balance is FULL. You can only receive a refund if the CallnRoam plan has a full balance and the purchase, identified by Registered ID (Registered #) was made in the past 60 days. All credits are posted back to the payment method used for the purchase.

Billing and Payment of Billed Charges. The Customer is responsible for paying all charges posted to their CallnRoam account, including but not limited to the monthly service fee, usage charges, international call-back charges, advanced feature charges, Device charges, U.S. regulatory fees and taxes. Charges, including potential disputed amounts, must be paid by the date shown on the CallnRoam account invoice or statement. CallnRoam calculates all rates at one-minute increments, rounded up to the nearest minute, commencing upon the first use of any services being provided. Customer agrees that (a) it would be impractical to determine the exact amount of CallnRoam's damages if you fail to pay promptly, and (b) in the event of such failure, Customer shall pay CallnRoam the amount due plus liquidated damages of one and one-half percent (1.5%) per month (or any portion thereof) of any amount unpaid when due. Liquidated damages shall be eliminated or reduced to the extent permitted by applicable law. If CallnRoam accepts late or partial payments or payments marked "Paid in Full" or similar notations, it will not waive any of CallnRoam or BridgeVoice's rights hereunder nor will it constitute an accord or satisfaction.

Credit Card Charges. No Credit Cards payments will be accepted by BridgeVoice from Credit Card Issuers that are not regulated Credit Card Issuers in the United States of America - U.S. Credit Cards only. You must provide and pay from a valid credit card (Visa, MasterCard, Discover, American Express or any other issuer then accepted by BridgeVoice) of which you are the authorized cardholder when purchasing, activating or recharging any BridgeVoice service. Should the Customer authorize automatic bill payment by credit card, it thereby authorizes BridgeVoice to charge the credit card account number for all applicable CallnRoam usage charges that accrue during their billing cycles. Such authorizations will remain valid until terminated by proper notice to BridgeVoice through this website, or, in writing. You must notify BridgeVoice in writing within 7 days after receiving your credit card statement if you dispute any BridgeVoice charges for CallnRoam services on that statement, otherwise such dispute will be deemed waived. Any applicable billing discrepancy resulting in the consumer initiating a charge-back by the credit card provider through Federal Truth in Lending Act, 12 C.F.R. Part 266 (1998), REG-Z, must be not be waived and BridgeVoice must be given a reasonable time investigate the nature of the Customer's claim, billing and the specific charge.

Online Bill Payment or automatic bill payment of CallnRoam Services. If you select an automated payment, either online or from a debit or credit card, you agree to authorize CallnRoam to charge any amounts payable by you in connection with your use of the Service automatically by that credit card or through electronic transfer from that account.

Failure to Pay. Upon advance notice, we may suspend, restrict, or cancel the Services and this Agreement, if you do not make payments for current or prior bills by the required due date. Service suspension or cancellation will result in the loss of the number associated with the Service.

Late Payment Charge. We may add interest charges to any past-due amounts at the lower of 1.5% per month or the maximum rate allowed by state law, prorated for each day payment is past due. Acceptance of late or partial payments (even if marked "Paid in Full" or with other restrictions) shall not waive any of our rights to collect the full amount of your charges for the Service. Notice of any disputes must be in writing and received by us within 30 days after you received your bill or you will waive any objection. You agree to reimburse us for reasonable attorneys' fees and any other costs associated with collecting delinquent or dishonored payments. If the state law where you receive the Service requires a different fee, we will charge you that amount.

Taxes. Any applicable sales, use, excise, utility or other taxes, fees or charges imposed on CallnRoam as a result of providing the Service or a Device will be added to Customer's account when imposed or required by law.

Account Number and Password Security. You, the Customer, are responsible for maintaining the confidentiality and security of your CallnRoam account online passwords. You are responsible for all uses of your account, whether or not actually or expressly authorized by you. Any unauthorized access of the Customers CallnRoam account that is the result of the Customer's negligent handling of any CallnRoam account number or password is expressly the liability of the Customer. The Customer expressly waives all legal defenses and relief against CallnRoam for any collectable debt that arises from the unauthorized access of their services, by and through their password and/or account, that is a result of their own mishandling, negligence, or intentional disclosure of their account Number, or password.

Written Notice To Customer By an E-Mail By activation and use of the CallnRoam Service, Customer agrees to all official Notices from CallnRoam to Customer shall be sent and delivered via e-mail. Customer represents that the e-mail provided CallnRoam is his or her account, or alternatively, is an e-mail account to which the customer has regular access, or alternatively is an e-mail account to which the customer agrees that notice remitted thereto are effectually received. Written Notice to CallnRoam through Customer Service Center By activation and use of the CallnRoam Service, Customer agrees to all official Notices from Customer to CallnRoam must be in writing (in the form of an e-mail, fax or letter) and shall be directed to CallnRoam's Customer Service Center at the following contact points: CallnRoam Customer Service Center (hours of operation 9am EST to 5pm EST Monday to Friday)Mainline to speak with a live operator 1-888-358-4002.

Use of CallnRoam Services. The CallnRoam Service is intended for Personal and Personal Business usage only. It is not intended to be aggregated, resold or provide primary services to call shops, call centers, telemarketing services or professionals, or any other variant of business usage outside of an individual's use of the service for Personal and Personal Business purposes. BridgeVoice reserves the right to review usage of the CallnRoam Service and terminate such service if it reasonably believes that the account is being used for purposes other than Personal and Personal Business usage only. You shall not resell or transfer the Service or Account Access to another party without our prior written consent. You are prohibited from using the Service or Account Access for auto-dialing, continuous or extensive call forwarding, telemarketing (including, without limitation, charitable or political solicitation), fax or voicemail broadcasting or fax or voicemail blasting. We reserve the right to immediately terminate or modify your Service if we determine, in our absolute discretion, that you have at any time used the Service or the Device for any of the aforementioned or similar activities.

No Directory Listing. The DID phone number you obtain from us will not be listed in any telephone directories. Phone numbers transferred from your local phone company (if applicable) may, however, be listed. As a result, someone with your phone number may not be able to utilize a reverse directory to lookup your address.

Use of United States Direct Inward Dial Numbers (DIDs) provided in connection with CallnRoam. CallnRoam Service DID is a U.S. issued number under the North American Numbering Plan and the DID does not presently offer or support the Service in any countries other than the United States. Calls made to your CallnRoam DID account shall be automatically routed to an international call-back of the caller party's international number from your CallnRoam Account and be directed to your registered U.S. telephone number. We reserve the right to terminate your Service immediately if we determine, in our absolute discretion, that you have used the Service or the Device outside of the United States.

Use of Non U.S. Direct Inward Dial Numbers (DIDs) provided in connection with CallnRoam. Customers that have international (non-United States) direct inward dial phone numbers ("DIDs") are provided with these numbers based on current United States and overseas regulations. These regulations are subject to change without notice and may be required to discontinue this Service, without notice. CallnRoam reserves the right to discontinue International DID services for any reason at any time and is only obligated to refund the pro-rated fees.

Export Control Laws. The export and re-export of Materials of this website are controlled by the export laws and regulations of the United States, as they may be amended from time to time. Accordingly, you certify that you are aware of and will comply with all applicable export rules and regulations, including the responsibility to obtain a license for the export or re-export of the Materials to any destination requiring such a license. In addition, the Materials may not be exported or re-exported to Cuba, Iran, Iraq, Libya, Sudan, the Taliban-controlled regions of Afghanistan or to any other country to which the United States prohibits the export of goods, technology or services or to nationals of those countries, wherever located. Moreover, neither the Software nor Materials may be distributed to persons on the Table of Denial Orders, the Entity List, or the List of Specially Designated Nationals maintained by the U.S. government. By downloading the Software and/or Materials you are certifying that you are not a national of one of the above-listed countries or of any other country to which the United States embargoes goods, services or technology and that you are not a person on the Table of Denial Orders, the Entity List, or the List of Specially Designated Nationals.

Inappropriate Use and/or Conduct as a cause for termination or breach of Agreements. Customer agrees to use the Service and/or Device for lawful purposes only. Customer shall not use, or allow any third (3rd) parties to use, the Service or the Device in any way that is unlawful, harmful, threatening, libelous, deceptive, fraudulent, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, discriminatory, or other objectionable material of any kind, including, without limitation, material that encourages unlawful conduct. If CallnRoam believes, at its sole discretion, that a customer has engaged in any of the foregoing conduct, CallnRoam reserves the right to (i) immediately suspend or terminate your Service; and/or (ii) forward the offensive materials, your communications with CallnRoam, and your identity and other personal information to the proper authorities for investigation and prosecution. The Customer consents to the forwarding of any such communications and information to these authorities or law enforcement. In the event of such termination, you will be responsible for the full month's charges to the end of the current term, including, without limitation, unbilled charges, plus a termination fee, if applicable, all of which will become immediately due and payable upon termination of your Service.

Inappropriate Content. You shall be solely liable for any and all liability that may arise out of the content transmitted by you or any person, whether authorized or unauthorized, using your Service or Device. You shall assure that the use of the Service and content comply at all times with all applicable laws, regulations and written and electronic instructions for use. CallnRoam reserves the right to terminate or suspend your Service and remove your content from the Service, if we determine, in our sole and absolute discretion, that such use or content does not conform to the requirements set forth in this Agreement or interferes with our ability to provide Services to you or others. Our action, or inaction, under this Section will not constitute any review or approval of your use or content.

CallnRoam and CALEA Compliance. Be advised that should a request come from governmental or law enforcement agencies, with the authority to require CallnRoam to report information related to your services, or, should law enforcement request this information or access pursuant to CALEA or the Patriot Act, CallnRoam shall be obligated to cooperate and disclose this information in accord with the laws of the United States of America and the State of New York.

NO WARRANTIES ON SERVICE. NEITHER CALLNROAM NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES OR AGENTS, OR ANY OTHER SERVICE PROVIDER OR VENDOR WHO FURNISHES SERVICES, DEVICES, OR PRODUCTS TO CUSTOMER IN CONNECTION WITH THE SERVICE, WILL BE LIABLE FOR UNAUTHORIZED ACCESS TO OUR OR YOUR TRANSMISSION FACILITIES OR PREMISES EQUIPMENT OR FOR UNAUTHORIZED ACCESS TO, OR ALTERATION, THEFT OR DESTRUCTION OF, CUSTOMER'S DATA FILES, PROGRAMS, PROCEDURES OR INFORMATION THROUGH ACCIDENT, FRAUDULENT MEANS OR DEVICES OR ANY OTHER METHOD, REGARDLESS OF WHETHER SUCH DAMAGE OCCURS AS A RESULT OF CALLNROAM OR ITS SERVICE PROVIDER'S OR VENDORS' NEGLIGENCE. STATEMENTS AND DESCRIPTIONS CONCERNING THE SERVICE, IF ANY, BY CALLNROAM, CUSTOMER SERVICE, OR ITS SALES AGENTS ARE INFORMATIONAL AND ARE NOT GIVEN AS A WARRANTY OF ANY KIND.

EXPRESSED LIMITATION OF LIABILITY. IN NO EVENT WILL CALLNROAM BE LIABLE TO THE CUSTOMER FOR (I) ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICES OR ANY TRANSACTIONS PROVIDED ON THE SERVICE OR DOWNLOADED OR HYPERLINKED FROM THE SITE, EVEN IF CALLNROAM OR ITS AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR (II) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE SERVICE AND/OR MATERIALS OR INFORMATION DOWNLOADED THROUGH, OR HYPERLINKED FROM, THE SITE. IT IS AGREED BY THE CUSTOMER THAT BRIDGEVOICE AND CALLNROAM ARE INDEMNIFIED, AND SHALL BE HELD HARMLESS TO ANY LEGAL CAUSE OF ACTION, OR DAMAGE OF ANY KIND, IN THE EVENT THAT THE CUSTOMER OR ITS CALLERS ATTEMPT TO USE THE SERVICE FOR 911 OR E-911 DIALING PURPOSES.

INDEMNIFICATION. The Customer agrees to indemnify, defend and hold BridgeVoice and CallnRoam, its officers, directors, employees, agents, shareholders, license, suppliers, business partners and any third party information providers to the Site, Services or Devices from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from Customer's use of any Services or Devices, including, without limitation, 911 Dialing, or any violation of this Agreement by Customer. The provisions of this paragraph are for the benefit of CallnRoam and its officers, directors, employees, agents, shareholders, licensors, suppliers, business partners and any third party information providers to the Site, Services or Materials. Each of these individuals or entities shall have the right to assert and enforce these provisions directly against Customer on its own behalf.

TRADEMARKS. All corporate names, service marks, logos, trade names, trademarks, websites and domain names of CallnRoam (collectively "Marks") are and shall remain the exclusive property of CallnRoam and nothing in this agreement shall grant Customer or any Third party the license to use such Marks.

COPYRIGHT. All Services found at this Website are protected by U.S. Copyright, or, by and through other intellectual property laws. Any commercial use of the Services Software and Materials found on the Website is strictly prohibited, without the express, prior, written consent of CallnRoam. Any reproduction or redistribution of the Services and/or Materials not in accordance with the terms set forth herein is expressly prohibited by law, and may result in severe civil and criminal penalties.

NO WARRANTIES ON WEBSITE. HYPERLINKS OR OTHER WEB PAGES ACCESSIBLE FROM THE SITE WILL ENABLE YOU TO LEAVE CALLNROAM'S SITE.
